Frage von robosobo:

Hello,
Unfortunately could find no clear answer in the forum, hence my question:
For a documentary, is synonymous to run at festivals, we would like to use the music of Richard Wagner. The copyright of the artist come to an end 70 years after his death, the related right of musicians 50 years after the recording.

Does this mean I can use recordings until 1959, without further ado?
Thank you and good grüsse,
robosobo

Hello!

You can not use the song without further ado, because (not only the author, Wagner), but the performers synonymous (; the orchestra, ect. Have) a claim.

If you are programming the unit via MIDI or it can even import of musicians, this issue falls away naturally.

Or do you strive for the rights for the recording that you want to use.
Most publishers are very responsive when a student film, or low-budget is Project.
(and I've already done a few times - it takes a little longer, but usually works and does not cost so much synonymous).

How it looks with the author of deadlines, I do not know exactly.
But I have something synonymous is one of 70 years after death.

Maybe you'd have time to see if there are heirs of the author and whether possibly have the rights. So I know myself, but not enough.

Greetings!

All well and true, but what it's still the issue at all?

Yes, synonymous the performers have rights, but I read s.anderer point that this so-called "related right" after 50 years expires.
Hence the question.
MIDI does not come into question, and unfortunately I'm orchestra synonymous none s.der hand. Perhaps I ask actually at times directly. What can it (licensing, about 5-10min Tannhauser and Lohengrin cost) for approximately? Budget is actually "low".

Antwort von Mink:

Have time to get paid a licensing agreement for two songs of a large current tape.

I have the label and the publisher assures that it is an absolute unkomerzielle thing is (; festivals, limited number) are in circulation DVDs, which have sent copies, and that's it ....

raussuchen ... So maybe a recording that you like, look who has moved the start times and contact .... You can get lucky ...

On the Gemaseite You can acquire licenses synonymous ....

Why do not you buy a track at www.shockwave-sound.com? They have an extensive and high quality provision at fair prices. Around $ 30 for a complete track and less for shorter sequences, I find okay. To test can be downloaded here synonymous preview files.

Thank c.herf, it's what I'll do well.
But to return again to my question:

Music that was recorded more than 50 years, and composer whose more than 70 years is dead - can I now use it or NOT?
I mean, to GEMA sure they can say that, but it would be synonymous here for the forum interesting (and I think), if the question could be clearly resolved ;-)

@ Pudu - synonymous a welcome tip.
Since it will go into the movie but to Ludwig II, and in parts of synonymous to Wagner, Wagner's Music of duty.

So for our short film for the Eu were told that it is ok European anthem of Beethoven, since he had been dead for 70 years but why do not you just phone to call with the competent authority and then post the answer here? It's nothing much effort :-)

Hi!
urheberrechte the amount to which the orchestra played the wagner.
Just look at times on the cd and ask.
asking costs nothing.

Antwort von camworks:

The performing rights are almost always maintained of the music label, has been released under the cd / disk. So better off and do not inquire directly with the orchestra. The guide next one anyway just to label it.

Let's count: a concert from the 20s: one of the musicians is 20 years old, thus born 1900th which is then cut in around 80 years old, so are most of the musicians have died in the late 1980s. is plus 50 years: 2030. And if one of the musicians was 100 or more years old, counting the 50 years s.da. much fun to wait at ... ;-)

but I would not use something. crackle old plates and the frequency response is not so tightly synonymous with shellac disks.

Although the two terms are often confused: There are two different things. Copyright is - as the name suggests - solely with the author of the work (and in this Falll So Wagner, who died in 1883). The musicians can play his work on the other hand rely on the related right. This distinction had already taken the questioner so synonymous quite right.

Interesting: the ends of performers' rights is now 50 years (after the recording, as shown in the receipt of posting) or analogous to the copyright 50 years after the death of the artist? The former I consider likely, and then there would be no preference how old is the musician.

hi bernd,

question to which I am not even come. But of course I googled and stood directly that it s.dem day of the performance is expected. So I once rowed back quickly. ;-)

However, the argument with the crackle and the response remains valid. could ever fit for film but synonymous ...

where the two world wars and the economic crisis so many labels have been closed. one would have to check with the gema, if the label still exists, and if not, whether there is one successor to inherit /. if one could use as synonymous recent recordings of bust-labels, which should then listen better.
