A new ruling could have considerable consequences for drone filmmakers. Thus, in a dispute between the collecting society Bild-Kunst and a publishing house, the Higher Regional Court of Hamm ruled that drone footage is not covered by the freedom of panorama.
![]() This was invoked by a publishing house which, in its book "Über alle Berge: Der definitive Haldenführer Ruhrgebiet" (Over all mountains: The definitive guide to slag heaps in the Ruhr area), shows aerial photographs taken by drone of several works of art erected on slag heaps without acquiring a license for them from the collecting society Bild-Kunst, which then took legal action. It is true that the works of art in question here are located on public paths, roads or squares, since the tailings piles on which the works of art were erected are either publicly accessible themselves or can in any case be viewed from public paths, roads or squares. However, the restriction of copyright by the freedom of panorama only applied to perspectives from public ways, streets or squares, but not to the air space. The Higher Regional Court of Hamm based its decision on a ruling of the Federal Court of Justice, which denied the freedom of panorama already for photographs taken from a ladder due to the new perspective. ![]() Das heißt, daß die Panoramafreiheit nur gilt, wenn Abbildungen eines Kunstwerks auch tatsächlich wie im Gesetzt definiert aus der Perspektive eines Passanten von einem Weg, einer Straßen oder Platz aus gemacht werden. Für Aufnahmen aus der Luft gilt es deswegen nicht. Das Urteil ist allerdings noch nicht rechtskräftig, weil der beklagte Verlag bereits Revision beim Bundesgerichtshof eingelegt hat.
